In recognition of a principle goal of punishment being reform of character, this code shall always endorse the sensible understanding that prisons must in some way provide an environment for reform.
|
|
| |
Furthermore, in recognition that not all crimes are the same, nor are sentences, nor convicted criminals exhibiting the same deficiencies, a "one model fits all " view of correctional facilities represents a medieval view of corrections and systems.
|
|
| |
In contrast, a system based on common sense that recognizes the need for different models of correctional facilities shall always be a core principle of this code.

The three level system
|
|
| |
By this code, the correctional system shall be divided into three levels of correctional facilities (prisons). Both the level and type of facility indicates is primary function, structure, security, operation and behaviour.

T1 = Prisoners with a sentence no greater than three years.
T2 = Prisoners with a sentence no less than three years and no more than twelve years
T3 = Prisoners with a sentence of more than twelve years |

T1 (under 3 years) |

T1 Correctional Facilities shall exist for the effective management of prisoners with custodial sentences of up to a maximum of three (3) years. |
|

As such, all T1 correctional facilities shall be designed for short term sentences. While a number of inmates may be repeat offenders, the majority are anticipated to be first time prison offenders.

|
Facility managing inmates refused bail, remanded into custody awaiting pre-sentence hearing, trial or sentencing.

Facility managing prisoners convicted of violent crimes, sexual related crimes, anti-social crimes

| Medical |
Facility managing prisoners suffering severe mental illness, incapacitation and those sentenced to medical facilities due to certified diagnosis of criminal insanity.

Community |
Facility managing prisoners not convicted of violent, gang, sexually related or anti-social crimes.
|

The primary purpose of T1 correctional facilities is to ensure that these people never offend again. Contrary to prevailing ideologies, these prisoners (if deemed guilty of violence and anti-social crimes) should be exposed to strong and constant discipline for the duration of their sentence.

T2 (3 to 12 year sentences) |
|

T2 Correctional Facilities shall exist for the effective management of prisoners with custodial sentences of sentences between three (3) to twelve (12) years. |
|
| |
As such, all T2 correctional facilities shall be designed for medium term sentences. |

| Medical |
Facility managing prisoners suffering severe mental illness, incapacitation and those sentenced to medical facilities due to certified diagnosis of criminal insanity.

| Educational |
Facility managing prisoners not convicted of violent, gang, sexually related or anti-social crimes who have shown a willingness for further education advancement. |
Community |
Facility managing prisoners shown a willingness for skills development to assist community based programs.

| 17.5 |
T3 (Longer than 12 year sentences) |
|
| |
T3 Correctional Facilities shall exist for the effective management of prisoners with custodial sentences of sentences of longer twelve (12) years and those awaiting a capital sentence. |
|
| |
As such, all T3 correctional facilities shall be designed for long term sentences. |
|

|
Facility managing anti-social and dangerous long-term prisoners convicted of violent crimes, sexual related crimes and other anti-social crimes who have forfeited their rights by their actions. Facility also manages capital crimes.

Facility managing prisoners suffering severe mental illness, incapacitation and those sentenced to medical facilities due to certified diagnosis of criminal insanity.
|
Community |
Facility managing long term prisoners shown a willingness for skills development to assist community based programs and build and manage their own community.
|
