12. Offences against the state
 
  Article 80-Offences relating to unlawful disclosure of classified information  
80.1 Classified information  
  Classified information is any information, regardless of whether it be in print, electronic or other media, which is deemed by the government to be strictly confidential and subject to control and regulation under matters of national and state security.  
 
 Primary Fact(s)
 1. That under law and/or regulation, certain information is deemed classified and therefore restricted from any type of handling including (but not restricted to) view/publication/replication unless proper authorization is given;
 2. That at a time an place certain classified information was handled in a way that was not properly authorized by law and/or regulation;
 3. That the actions of the accused contributed to the unlawful handling of the classified information;
 4. That the actions of the accused were done with the knowledge and intent of unauthorized and unlawful handling of the classified information;
 
 
 Penalty Conditions (Level 2-Offence)

a) any kind of publication in a public medium by an individual;

a) any kind of publication/broadcast in a public medium by an media organization;
 
 
 Penalty Conditions (Level 3-Offence)

a) any kind of unauthorized reproduction of classified documents by a citizen;
4-6
a) any kind of unauthorized reproduction of highly classified documents by a citizen;
 
 
 Penalty Conditions (Level 4-Offence)
Type
Condition(s)
1-3
a) any kind of unauthorized reproduction of classified documents by a foreign-national;
4-6
a) any kind of unauthorized reproduction of highly classified documents by a foreign-national;
